Resolved Question: Is a property management company required to keep a security deposit in a trust account?

I signed a 12 month lease in April, 2009 for a property through a management company. In late October I found a notice on the door notifying me that the home was due to go to auction on November 17th, 2009. When we contacted the owner of the property management company, he acted as if he knew nothing. It turns out that the owners stopped making payments in January – 4 months prior to me signing the lease.

I informed the owner of the property management company that I would no longer be paying the rent and that I wanted my deposit returned. He stated that he had given the security deposit to the owner. He knowingly rented me a property that was going into foreclosure so that his owner friend could collect “free” money from me. Do I have any legal recourse?
